Even if you don't include metadata on the photograph, a company still cannot legally use your wedding photograph without permission. Here's why:
1. **Copyright Protection Without Metadata**
- **Automatic Copyright:** Copyright protection is automatic the moment a photograph is created, regardless of whether it includes metadata or not. Metadata (such as EXIF data) typically contains information like the date the photo was taken, the camera settings, and the photographer's name. However, the absence of this data does not negate your or the photographer's copyright protection.
- **No Requirement for Metadata:** You do not need to include metadata for a photograph to be protected under copyright law. The photograph is still your intellectual property, and you (or the photographer) retain all rights to control its use.
2. **Company's Responsibility**
- **Due Diligence:** Companies are responsible for ensuring they have the necessary permissions before using any photograph, regardless of whether metadata is present. If they use a photo without obtaining permission, they may be infringing on the copyright, which could lead to legal consequences.
- **No Excuse for Infringement:** The absence of metadata does not give a company the right to assume that the photo is free to use. They are expected to verify the copyright status of the image and seek the appropriate permissions.
3. **Rights as the Subject of the Photo**
- **Consent Still Required:** Even without metadata, as the subject of the photograph, your consent is generally required for the image to be used commercially. Privacy and publicity rights protect you from unauthorized commercial use of your likeness, and these rights are independent of metadata.
4. **Legal Recourse**
- **Infringement:** If a company uses your photograph without permission, you have the right to pursue legal action, metadata or not. The strength of your case is not diminished by the lack of metadata, as copyright and personality rights are still in force.
In summary, the lack of metadata on a photograph does not affect your or the photographer's legal rights. A company must still obtain permission before using the image. If they use it without consent, they may be infringing on your rights, and you would have grounds to seek legal recourse.
